1. What Data Does Heavystore Process?
Heavystore is a platform for suppliers and interested parties of construction machinery and equipment. In principle, you can visit our site without registering and actively providing us with personal data. In this case, we only collect the following data:
- File name of the page or file or information passed by you in the context of entries (e.g. query parameters in the URL);
- File name of the page from which the current page or file was requested;
- Date and time of the request;
- Amount of data transferred;
- Access status (page transferred, page not found, etc.);

- Statistics on page views, traffic data and advertising data (in each case via cookies - see below under Cookies).

If you decide to actively trade on our marketplace, registration is required, during which we collect the following data from you:
- As provider: E-mail address and password, first name, last name, street and house number, postcode and town, area code and telephone number.
- As a commercial provider: Salutation, first and last name, address, e-mail address and telephone number, company name, VAT number, user name, mobile phone number (optional), fax (optional). As well as contact person for contractual questions, different billing address, different business address, if entered.
- As enquirer: E-mail address and password, title, surname, first name, postcode, current vehicle ownership, customer type (private/commercial).
1.2 Data You Enter at Heavystore
Depending on the capacity in which you use which function of the platform, we collect further data that you enter in our platform. You are not obliged to provide the respective information; however, without this data you may not be able to use the respective function. We inform you about data that we collect in connection with your use of the platform here:
- As a user of the vehicle/machine search function: Information about the type of vehicle/machine searched for (make, model, price, first registration, mileage, power, vehicle condition and comparable data).
- As a user of the Sell / Advertise function: Information about the type of vehicle offered (vehicle type, manufacturer, type, model, price, first registration, mileage, performance, vehicle condition, vehicle identification number (VIN), photos and comparable data), about the advertisement (duration).
- As a user of contact forms: Salutation, first and last name, address, email address and telephone number and other details relating to the contact.
- As a subscriber to newsletters and mailings: E-mail address and, if indicated by registration as a provider, first name and surname for salutation, further data such as postcode for the playout of local offers, as well as further personalisation based on consumer behaviour (e.g. search history, advertisement content); in order to be able to optimally design our newsletter according to your interests and wishes, the clicks on the links in the e-mail newsletter are registered and stored.
- As a user of the online trader registration: Title, first and last name, address, e-mail address and telephone number, company name, VAT number, user name, mobile phone number (optional) fax (optional). As well as contact person for contractual questions, different billing address, different business address, if entered.
- As a user of the trader exclusive offer: Offer text, end date of the offer.
- As a user of the merchant email management: Salutation, position, first name, last name, email address, notification type.
2. For What Purposes and on What Legal Basis Does Heavystore Process Your Data?
We process your data mainly to provide you with the offer and the associated services and functions. In addition, further processing takes place for other purposes, which we describe below together with the respective legal basis. Among other things, we use various procedures on the platform to analyse usage and to display online advertising (both also using cookies). In addition, we process data for the purposes of direct advertising via e-mail and for security and legal tracking purposes.
2.1 Provision of the Portal
We process your data in order to provide you with the offer and the associated services and functions. When using the contact form within the advertisements on our platform, the contact information entered by the interested parties is transmitted to the advertisers.
We store and process the vehicle data you provide us with (vehicle type, manufacturer, type, model, price, first registration, mileage, performance, vehicle condition, VIN) for the purpose of statistical evaluations and their publication beyond the display period.
In order to ensure that your offers/advertisements are noted by as many interested parties as possible, we sometimes also disseminate advertisements via cooperating car exchanges/websites. This means that we pass on your data, as publicly displayed in the advertisement, to the cooperating car exchange/website. We also send your advertisements by notification e-mail to interested parties who have subscribed to a search request and share your advertisements on social media (such as Facebook).
In some areas, we allow you to rate partner and third-party services found through our platform as a guide for other users. For this purpose, we will send you an email asking you to submit such a rating.
In addition, we process your data insofar as this is necessary for the implementation and processing of contractual relationships entered into, for example for sending invoices or for contacting you in the event of problems arising.
These processing operations are carried out on the basis of statutory provisions that allow us to process personal data insofar as it is necessary for the use of a service or the performance of a contract (e.g. Section 15 (1) TMG; Art. 6 (1) b) DSGVO), or because Heavystore has an overriding legitimate interest in making the use of the platform as easy and efficient as possible (Art. 6 (1) f) DSGVO). 2.2 Statistical Evaluations and Needs-Based Design (Cookies)
When you use our services, we create user profiles using pseudonyms for the purposes of statistical evaluation and the needs-based design of the services. This processing is carried out on the basis of legal regulations that permit the processing of personal data because Heavystore has an overriding legitimate interest in a demand-oriented design that is geared to user habits and in the statistical evaluation of our offer (e.g. § 15 para. 3 TMG, Art. 6 para. 1 f) DSGVO).
For this purpose, we use so-called cookies, i.e. alphanumeric identification characters that we transmit to your computer by means of your web browser. They enable our systems to temporarily distinguish your browser from others. On the one hand, we send you so-called persistent cookies, with the help of which we record the search criteria entered by you in the context of our auto-database and store them for our internal evaluations.
On the other hand, we use so-called session cookies, with the help of which you receive a session ID for the duration of a visit to our pages, which enables us to recognise you as a specific (anonymous) user. This enables us to create continuity for you during your visit and, for example, to prevent you from being shown the same advertisements over and over again. 2.3.1 AdWords
We have integrated Google AdWords on this website, a service of Google. Inc. (1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA; "Google"). AdWords is an Internet advertising service that allows advertisers to place ads in Google's search engine results as well as in the Google advertising network. Google AdWords allows an advertiser to specify certain keywords in advance, by means of which an ad is displayed in Google's search engine results exclusively when the user retrieves a keyword-relevant search result with the search engine. In the Google advertising network, the ads are distributed on topic-relevant websites by means of an automatic algorithm and taking into account the previously defined keywords.
The purpose of Google AdWords is to advertise our website by displaying interest-relevant advertising on the websites of third-party companies and in the search engine results of the Google search engine and to display third-party advertising on our website.
If a data subject accesses our website via a Google ad, a so-called conversion cookie is stored by Google on the data subject's information technology system. A conversion cookie loses its validity after thirty days and does not serve to identify the data subject. - Registered users: Data is stored until you delete your account, with backups retained for up to 14 days.
- Consent-based data: Data is stored until you revoke consent.
